VAMA CUCINE BY C-INTERIORS SRL GENERAL TERMS AND CONDITIONS FOR WEBSITE SALES

1) INTRODUCTION

Welcome to the C-Interiors Srl Terms and Conditions which apply to orders made online via our Website, www.vamacucine.com. C-Interiors Srl (which we will refer to throughout as “C-Interiors, we, our, us”) is a company registered in Italy, VAT n° 02674520412 and we have our registered office in 6 Via Monti, 61121 Pesaro (PU), Italy. We reserve the right to change these Terms from time to time. In light of this, it is important that you check these Terms every time you wish to place an order through the Website to ensure you understand the terms that apply at that particular time.By using and placing orders through the Website, you confirm that you accept these Terms and that you agree to comply with them. Nothing in these Terms and Conditions shall affect your statutory rights.

2) DEFINITIONS

In these Terms, when the following words with capital letters are used, this is what they will mean:

“Contract”: means the contract for the purchase and sale of the Products through the Website.

“Event(s) Outside Our Control”: means any act or event beyond our reasonable control which may delay or prevent production or delivery of the Products. These acts and events may include, without limitation, acts of God, flood, drought, earthquake or other natural disaster, epidemic or pandemic, terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations, nuclear, chemical or biological contamination or sonic boom, any law or any action taken by a government or public authority, including imposing an export or import restriction, quota or prohibition, or failing to grant a necessary licence or consent, collapse of buildings, fire, explosion or accident, any labour or trade dispute, strikes, industrial action or lockouts, non-performance by suppliers or subcontractors, and interruption or failure of utility service.

“Order”: means an order for Products.

“Product(s)”: means any product which we make available for sale through the Website.

 “Terms”: means the C-Interiors Terms and Conditions of sale.

“Website”: means our website at www.vamacucine.com

“You” or “you”: means the individual who is purchasing the Products.

3) THESE TERMS

  1. a) What these Terms cover. These are the Terms on which we supply Products to you to purchase via the Website.
  2. b) Why you should read them. These Terms tell you who we are, how we will provide Products to you, how you and we may change or end the Contract, what to do if there is a problem, and other important information.
  3. c) Reading and accepting the Terms. You must accept these Terms in order to place an Order with us through our Website.
  4. d) Changes to these Terms. We reserve the right to change these Terms from time to time without notice and any changes will take effect on the day they are posted on the Website.

4) PLACING AN ORDER ONLINE

  1. a) Conditions of use. To be able to place an order you must:
  2. i) be over the age of 18;
  3. ii) provide us with all the required information that we need for us to be able to successfully complete your order which may include, but is not limited to, details such as your name, address, telephone number and payment details;

iii) be purchasing Products to be sent to an address where we are able to deliver and a valid phone number

  1. b) Refunds will usually be made within 14 days and in the same way as the original payment.
  2. c) Make sure you provide the correct information. We are not responsible for any errors you make when you place your Order. It is your responsibility to ensure that you input and submit your Order details accurately and fully.

5) OUR CONTRACT TO YOU

  1. a) How we will accept your order. Our Contract with you will exist when you pay in full, after receiving an email from us setting out the description of the Products you have ordered.
  2. b) If we cannot fulfil your Order. If we are unable to fulfil your Order for any reason, we will contact you with further information and will not process your Order. We will refund any deposit paid by you in respect of your Order. Any refunds will usually be made within 14 days.

6) OUR PRODUCTS

Products may vary slightly from their pictures displayed on our Website. The images of the Products on our Website are for illustrative purposes only. We make every effort to display the colours accurately, but we cannot guarantee that your computer’s display of the colours accurately reflects the colour of the products.

7) PRODUCT CHANGES

We may change the products: (A) to reflect changes in relevant laws and regulatory requirements and (B) to implement minor technical adjustments and improvements, for example to address a security threat.

8) PROVIDING THE PRODUCTS

  1. a) Delivery costs
  2. i) The prices of our products include freight in Europe, except for items weighing more than 70 kilograms. In the latter case, we will provide you with a personal delivery quotation.
  3. ii) Products may be delivered by trusted third parties.
  4. b) When we will provide the Products.
  5. i) You will be informed of the likely approximate length of delivery time when we confirm your Order. We will contact you to agree suitable arrangements for the date of delivery.
  6. ii) Every effort is made to see that the delivery date is accurate, but on occasion the manufacture or delivery of your furniture may be delayed due to circumstances beyond our control, including but not limited to an Event Outside Our Control, and we cannot accept responsibility in this respect. We will, of course, make every effort to keep you informed if a delivery date will not be met.
  7. c) When you become responsible for the Product. A Product will be your responsibility from the time we deliver it to the address you provided to us.

9) YOUR CONSUMER RIGHTS

  1. a) You have certain rights if what you have bought is faulty or damaged at the time of delivery. If a Product is found to be faulty or damaged at the time of delivery you will have the following options:
  2. i) A right to reject the Product. In this case it should be returned to C-Interiors and a full refund of all monies paid will be made to you as soon as possible, usually within 14 days of rejection being accepted and via bank transfer.
  3. ii) A right to keep the Product.
  4. b) If fault or damage is discovered up to 30 days after delivery. If any fault or damage is discovered within 30 days of delivery, please contact us as soon as you notice the defect. We will discuss your options including repair or replacement. In the event that a repair to the Product cannot be made, we will replace the Product or give you a full refund including any delivery charges. Again, the Product must be returned to C-Interios before a refund can be given.
  5. c) Right to cancel – Cooling Off Period. Where you purchased Products (not including bespoke items or custom made to your specifications), then you are entitled to change your mind and cancel your Contract up to 14 days after delivery.

You will be entitled to a full refund of the price paid for the Products; however, we are entitled to reduce the amount of any refund to reflect any reduction in the value caused by you or if you have failed to take reasonable care when handling the Products. In all cases above the cost of returning the product is your charge.

If the Cooling Off Period applies and you wish to cancel, please contact us in writing as soon as possible. If you are exercising your right under this clause you must arrange for the return of the Products to us showing no evidence of use within 14 days of you telling us you wish to cancel the Contract. Whilst the Products are in your possession you must not handle them beyond what is necessary to establish their nature, characteristics and function. It is your responsibility to return any Products in a good condition and we ask that you return the Products in appropriate packaging such as to prevent damage in transit.

10) OUR RIGHTS TO END THE CONTRACT

  1. a) We may end the contract if you fail to make payment to us when it is due, do not provide us with information that is necessary for us to fulfil your Order; for example, you fail to provide your address, or if you do not within a reasonable time frame allow us to deliver the Products to you.
  2. b) If we have no option but to end the contract with you then we may be entitled to a contribution towards any costs we have incurred, for example if we have started making the Products you have ordered. This contribution can be taken out of any refund owed to you as a result of the Contract ending.

11) PAYMENT METHOD

We accept payment with Paypal and by bank transfer, and details will be provided on request.

12) COMPLAINTS

If you are unhappy with any aspect of your Order or the service you have received from us we want to hear about it.
